Market exclusivity data exclusivity and S 3921
There has been some confusion lately regarding the distinction between “data exclusivity" and "market exclusivity.” For most newly approved drugs, US law only provides "data exclusivity," five years for small molecule drugs and 12 years under the newly enacted biosimilar legislation. During the period of data exclusivity, generic competitors are prevented from relying on data generated and paid for by the innovator to secure FDA approval for a generic or biosimilar version of the innovator drug. This is not the same as market exclusivity, because a generic company is free to generate all of its data from scratch to obtain marketing approval for their generic version of the drug, although in practice is rarely if ever happens. True market exclusivity would completely preclude generic competition, while data exclusivity simply provides a period of time during which generic competitors are not permitted to rely on innovators data to obtain marketing approval.
In contrast, the Orphan Drug Act provides a period of true market exclusivity for certain orphan drugs, which precludes FDA from approving a competing version of the same or highly similar drug product to treat the same orphan disease for a period of seven years. The key difference between marketing exclusivity and data exclusivity is that a competitor cannot circumvent marketing exclusivity by generating its own data and submitting a new application for FDA approval, it is an absolute bar to FDA approval of the same drug for the same indication.
Recently, members of Congress sent a letter to the FDA seeking to clarify this point. In the letter, signed by four Senators including Orrin Hatch and John Kerry, the Senators point out that in a recent notice published by FDA seeking comments on the newly enacted biosimilar legislation, FDA incorrectly states that the biosimilar legislation provides a 12 year period of “marketing exclusivity.” The letter quite correctly point out that the biosimilar legislation in fact that does not include any marketing exclusivity period, but rather a 12 year period of data exclusivity.
Perhaps FDA should be excused for the lapse. Reporters and commentators routinely refer to the data exclusivity provided for biologics as "market exclusivity." To see what I mean, just do a Google search for “Obama budget biologic marketing exclusivity,” and you will pull up numerous reports from leading news agencies and bloggers reporting that the Obama budget proposes reducing the market exclusivity period for biologics from 12 years to seven years. In fact, there is no market exclusivity period for biologics, only data exclusivity, they should all read the letter from the Senators and stop propagating the misperception that the biosimilar legislation provides a period of market exclusivity.
I suspect part of the reason people have taken to characterizing data exclusivity as market exclusivity is because it suits the purposes of those who would like to speed to market entry by generic competitors by lowering the barrier to entry of generic competition. When you characterize it as market exclusivity, it sounds like market competition has been completely blocked for 12 years, which is very different from a 12 year period in which competitors cannot free ride on data paid for by the innovator.
For example, in a report on biosimilar legislation prepared by the FTC in 2009, a report of which Ive been highly critical, the FTC repeatedly refers to the data exclusivity provisions of biosimilar legislation as marketing exclusivity. FTCs mischaracterization of data exclusivity as marketing exclusivity might have been an attempt to strengthen its argument by implying that no biosimilar product could enter the market during the 12 year data exclusivity period, when in fact this is not the case. But this mischaracterization has spread, apparently leading to confusion even at FDA, and thus necessitating this letter from the Senators.
Related to this debate is the "Ethical Pathway Act of 2010," (S. 3921), a bill introduced into the Senate by Senator Sanders on September 29, 2010, which would effectively eliminate any data exclusivity period for both conventional drugs and biologics. Under this proposed legislation, as I read it, an innovator would be forced to share its clinical and animal data with a competitor, to be used by the competitor to obtain FDA approval for a generic or biosimilar product. The bill includes provisions for a "cost-sharing arrangement," pursuant to which the generic company would be required to compensate the innovator for some of the costs incurred in generating the data. If the innovator and generic company cannot agree on the amount, they are required to submit the matter to an arbitrator who is to determine a "reasonable and fair fee.”
The bill identifies specific factors to be considered in determining the "reasonable and fair fee," including "actual out-of-pocket costs of the applicable clinical investigations, the risk of the investigations, as reflected in the probabilities that similar investigations result in successful applications for marketing, any federal grants, tax credits, or other subsidies that reduce the net cost of the investigations, the expected share of the global market for the product involved, by the party seeking to rely upon the investigations for marketing approval, and the amount of time the holder or holders of the relevant applications for licenses has benefited from exclusive rights, and the cumulative revenue earned on the products that relied upon the regulatory tested at issue."
I think it is reasonable to predict that innovators are highly likely to be undercompensated by this imposed "cost-sharing arrangement." Essentially, after the innovator company has taken on a huge amount of risk bringing a drug to patients, and then establishing a market for the drug, this bill would allow a competitor to free ride off all of this risky investment by simply paying some fraction of the cost for clinical trials. As reported last Monday in Reuters, a survey has found that traditional small molecule drugs have only a 7% chance of making it from phase I through FDA approval. The success rate is even lower for some of the most important drugs-4.7% for cancer drugs, and 5.7% for cardiovascular drugs. There needs to be powerful financial incentives to invest huge amounts of money when there is such a low probability of a payoff, which I think helps explain why we are seeing such a dramatic drop-off in pharmaceutical R&D spending and in the rate of new drug approvals.
When generic competition hits the market, the innovator does not just lose a piece of the pie, the pie shrinks dramatically. Innovators need some substantial period of exclusivity on the market in order to bring in the profits that ultimately drive innovation. Patents play an important role in this regard, but patent protection is unpredictable and not always available, even for important and innovative life-saving drugs, and this is particularly true in the case of biologics.
To me, this is analogous to me going to the racetrack with a friend, and deciding to bet $1000 on a longshot horse. If the horse comes in, and I win $25,000, it is certainly not fair for my friend to wait until the race is won and then demand that I accept $500 (half the price of the bet) in exchange for half of the winnings ($12,500). But this is essentially what the "cost-sharing arrangement" under the proposed legislation would entail. In fact, its even worse than that, because to take the analogy further, since generic competition reduces profits for everyone, were not talking about sharing $25,000 anymore, but substantially less than $25,000.
While the legislation would hurt innovators, and ultimately innovation, it is premised upon a quite legitimate ethical concern, i.e., conducting clinical trials on human beings when we presumably already know the product is safe and effective raises substantial ethical issues. While I agree this is an entirely valid concern, I dont think it should be addressed in a manner that substantially reduces incentives for future innovation.
I would suggest that perhaps the best way to deal with these concerns is to provide drug innovators with an actual period of marketing exclusivity, independent of patent rights and independent of data exclusivity. This would give innovators a period of market exclusivity in which to recoup profits that incentivize innovation, without having to worry about patent challenges, and without subjecting human subjects to unnecessary clinical trials.

One of the best ever sports based films ever made. In fact, this film is not only about guts and glory, but dwells into topics much deeper than that. Neeraj Pandey delivers yet another masterpiece.
The duration of the movie is big let-down, and the director could have cut down on those unnecessary songs, which slow down the pace of the movie. The entire movie is capped off by a brilliant ending.
Sushant was absolutely brilliant and flawless in the movie, thus adding yet another feather to his already highly decorated cap. All the other actors too have played their parts. On the whole, this movie was not only an entertainer but also keeps you hooked to it for a good three hours. And rarely has a Bollywood movie been this good. Truly an inspiring movie... Hats off to the entire team for creating such a masterpiece !!!!

En torno a 1969-1970 el género de Terror sufrió una serie de transformaciones que lo modificaron y condicionaron para siempre. De alguna manera (en mi subjetiva y discutible opinión) el cambio de década supuso un punto de inflexión, un límite, una frontera perfectamente definida que marcó un antes y un después.
El viejo terror clásico dio paso a nuevas formas, nuevos argumentos, nuevos modos, abandonando los escenarios y estéticas anteriores. El entrañable y queridísimo Gótico Italiano pasó a mejor vida, mientras el Giallo (que mezclaba el terror propiamente dicho con el suspense, el tema policiaco y cierto tremendismo visual) tomaba el relevo. Las viejas historias de vampiros, criptas y cementerios decimonónicos fueron sustituidas por asesinos en serie, monstruos humanos (no sobrenaturales), disfuncionalidades psíquicas y/o sociales y familiares y truculencias explícitas. Todavía no había llegado la eclosión splatter y gore de finales de los 70’s, pero ya podía adivinarse en el horizonte que, tarde o temprano, las sierras mecánicas, los taladros eléctricos y los cuchillos carniceros iban a adueñarse del género en un tiempo más o menos breve.
Estados Unidos comenzaba a recuperarse de su “decadencia” y llamaba de nuevo a las puertas del género, reclamando una posición dominante que había perdido diez, quince, veinte años atrás a favor de Europa (y, principalmente, del Brit-Terror).
En concreto, en las Islas Británicas, todavía detentadoras de la hegemonía, la evolución era evidente. La gloriosa Hammer, que desde finales de los 50’s y durante toda la década de los 60’s había encadenado una joya tras otra con un éxito incontestable, comenzaba a experimentar dificultades. El viejo goticismo marca de la casa no terminaba de enganchar con el nuevo público de jóvenes post-swingin’ London que demandaban emociones fuertes y erotismo explícito. La productora no quiso dormirse en los laureles, y comenzó a experimentar tratando de recobrar la hegemonía y el favor de la taquilla. No obstante, a pesar de echarle imaginación a la cosa, nunca renunció en el fondo a la vieja “marca de la casa”, tan querida y característica. Buscó nuevos giros argumentales, como la mezcla de capa y espada con el tema vampírico que supuso “Captain Kronos, Vampire Hunter” o la tremenda “The Seven Golden Vampires” (A.k.a. "Kung-Fu Contra Los Siete Vampiros De Oro" en la que los chupasangres se mezclaban con las Artes Marciales e, incluso, con el western. Vamos... el sueño de un chaval de ocho o nueve años en los 70s hecho realidad), actualizó el personaje estrella de la casa, el buen y viejo conde Drácula, ambientando sus aventuras en la más estricta contemporaneidad (“Dracula 72 A.D.” y “The Satanic Rites Of Drácula”) y terminó asumiendo las nuevas modas satánicas en la estimable e infravalorada (y última película de género que la productoras firmó, por cierto. Su canto del cisne) “To The Devil A Daughter”.
Pero, como ya he dicho, nunca abandonó sus querencias goticistas, sus ambientes centroeuropeos y sus vampiros de toda la vida, con sus colmillos puntiagudos y sus capas negras, como debe ser y comodiosmanda.
Lo que sí hizo la Hammer, en ese cambio de década, fue plegarse al nuevo gusto por lo erótico sin mayor problema. La productora siempre había tenido muy presente ese aspecto (aquellos rotundísimos escotes de Yonne Romain o Dana Gillespie, las piernas perfectas de Barbara Shelley, los impresionantes bikinis prehistóricos de Raquel Welch y Martine Beswick... y ya vale, que me encano...), así que no hubo dificultad en adaptarse a los tiempos. Los camisones se hicieron más trasparentes, los escotes más pronunciados y las situaciones más explícitas. Se ficharon nuevas hammeretes, más jóvenes y dispuestas a desnudarse como las gemelas Collinson (recién coronadas como playmates del mes en Octubre de 1970), la deliciosamente exhuberante Valerie Leon, la pizpireta Madeleine Smith, la tremenda Veronica Carlson, la delicada Yutte Stensgaard o la desarmante Ingrid Pitt y asunto solucionado. Para que la cosa quedase clara, se inició un nuevo ciclo vampírico, el conocido como La Trilogía Karnstein, en el que el personaje de Drácula fue sustituido por el de la famosa vampira creada en el relato homónimo de Joseph Sheridan Le Fanu (desde mi punto de vista, en la creación icónica del vampiro cinematográfico y literario anterior a esa caterva de adolescentes colmilludos y con problemas hormonales que ahora nos aflige y a los homoerotizantes y lánguidos vampirillos de Anne Rice, el vampiro de toda la vida, vaya, tan importante es la novela de Mr. Le Fanu como el Drácula de Stoker). Carmilla, Mircalla, Marcilla, sea cual sea el nombre elegido (todos valen) es, de alguna manera la protagonista de la trilogía, compuesta por tres películas: “The Vampire Lovers”, “Twins Of Evil” y “Lust For A Vampire” y datada entre 1970 y 1971
En la primera (y para mi gusto la mejor de la saga) el protagonismo recae sobre la maravillosa y guapísima Ingrid Pitt, generosa de camisones trasparentes y caricias sáficas. En la segunda son las gemelas Collinson las que se dedican a pegar mordiscos a los que se les ponen por delante y a abrirse el escote del camisón para hipnotizar al más pintado... Y en la tercera, que es la que ahora cuelgo, el papel de vampira rozagante y mollar lo asume la rubia y escandinava Yutte Stensgaard.
No es ésta la mejor película del ciclo, desde luego, pero tiene su aquél...
Sigue siendo puro Hammer. El escenario, como no podía ser menos, es esa Estiria indefinida en el corazón de Centroeuropa, con topónimos y nombres alemanes, pueblos típicos, curas católicos, aldeanos en blusón y mocicas recién sacadas de un cuadro típico. Castillos tardomedievales, criptas góticas y bosques umbríos. Y, en este caso, para sazonar con más picante el guiso, un internado femenino lleno de adolescentes sonrosadas cuyo pecho se agita delicado y rotundo bajo el escote recto del vestido estilo imperio que todas lucen (estamos en el primer tercio del siglo XIX, of course).
Como ya he dicho, la peli paga tributo a su tiempo y a los condicionantes que la Hammer había asumido para mantener la cuota de mercado. Un erotismo soft y en absoluto agresivo que, visto hoy, no sólo resulta inocentón sino hasta un poco ñoño. Y, por si faltaba algo, incluso hay hueco para meter una cancioncilla semipop (más bien easy-listening) para que sirviese de banda sonora ambiental en la escena erótico-pastoril en la que vampira deviene enamorada, ejem (Al fin y al cabo era algo normal en aquellos años. Piensen voacés en “Dos Hombres y Un Destino”, “Casino Royale”, “La Balada De Cable Hogue”, “The Thomas Crown Affair”, etc... Donde menos se lo pensaba uno, saltaba la liebre y aparecía una canción pop. Y algunas siguen sonando deliciosamente bien treinta años después, por cierto).
La señorita Stensgaard no ha pasado a la historia, precisamente, por sus dotes interpretativas. Era una jovencita adorable y sumamente atractiva (y me quedo corto, ejem...) pero limitadísima como actriz. Así que la peli no puede por menos que resentirse de ello; y ni siquiera la presencia siempre eficaz de Ralph Bates y otros secundarios típicos de la Hammer cubre ese flanco. Por otra parte, el argumento es otra variación de la historia de Carmilla que ya se había desarrollado (con diferentes giros argumentales pero con la misma trabazón básica) en las anteriores películas de la mini-saga, las aludidas “Vampire Lovers” y “Twins Of Evil”. Vamos... que “Lust For A Vampire”, como ya he dicho, no es la mejor película de la Hammer (y, de hecho, es la más flojica de toda la Trilogía Karnstein).
Pero... ¡Qué diablos...! Todavía es una cinta de brit-terror de su época dorada. Todavía están ahí todos los detalles y motivos que, no por manidos y comunes, siguen siendo encantadoramente reconfortantes. La fotografía, la ambientación, la corrección narrativa, el respeto por el espectador (del que no se piensa que es un estúpido dispuesto a tragarse cualquier barbaridad). Todo eso sigue ahí.
Y, además, la rubia y juncal Yutte no sería una actriz del método, pero a fe mía que resulta una vampira especialmente sugerente y deleitable (vamos... que al verla venir de frente, más que dejarse morder, lo que uno haría es morderla a ella, ejem...).
Pues eso, mes amis. Que la peli, a pesar de sus deficiencias y limitaciones, sigue siendo perfectamente disfrutable y agradecida. Y una de la Hammer siempre será una de la Hammer, qué coñe...
Está cortada con File Splitter & Joiner. Va en inglés original con subs en castellano en archivo aparte (son los primeros subtítulos que yo hice. En realidad aproveché una traducción previa de un compañero latinoamericano y la modifiqué de cabo a rabo). Se trata de un DVDRip con muy buena calidad de imagen.
Curiosamente, las otras dos películas de la trilogía Karnstein están publicadas en DVD en España (“Las Amantes Del Vampiro” y “Drácula Y Las Mellizas” son los títulos con los que se las puede encontrar), pero ésta tercera no.

Im the first to admit, London fashion week is too fashion forward most of the time for me to understand. Luella is the exception. Mostly because she is quirky in a preppy way, which I can appreciate. Her runway gives me ideas on how I can twist and tweak the preppy pieces I already own to become more quirky and "new". This season, she doesnt disappoint.
I absolutely detest orange. But somehow Luella makes it work by clashing it with hot pink and a vibrant blue on the runway. The outfits actually look cute and girly, instead of pumpkin-esque! Hmm...maybe Ill get something orange next season. I already have a pair of black plastic rimmed glasses!The other innovation on the runway was the asymmetrical tiered skirt. Im not quite sure how I feel about that yet, Ive always been a fan of symmetry. But it is definitely quirky and different, it could even be cute and fun (there is an even more asymmetrical skirt than the one shown here on the runway- this is the less adventurous version). And of course, there was the usual Luella floral prints all over the runway- I love how she somehow makes it appear edgy instead of old fashioned.
Another thing I love about the Luella show is how she mix and matches prints. That soft pink floral top totally works with the bold pink stripe pants! And that lavender floral dress is just adorable. In fact, the poofy skirt and the tulles even gives it a prom-like quality (not that you would not look completely darling and perfect wearing this to a more sophisticated occasion!). sinopsis:
Un piloto de pruebas atraviesa la barrera del sonido y viaja al futuro, al año 2024, encontrando una civilización subterránea diezmada por una plaga apocalíptica que los convierte en sordomudos estériles. Una vez que se convence de la realidad de su situación, intenta regresar a su época para advertir a sus contemporáneos del peligro de las pruebas atómicas, y evitar así el desastre atómico... Pero se enamora de la hija del gobernante supremo, y planea llevarla consigo. En el final, todo se complica con el ataque de los peligrosos mutantes de turno.

A principios de 1960, Edgar G Ulmer fue contratado por la American International para realizar dos filmes que deberían componer un programa doble de ciencia ficción. En apenas quince días rodó “Beyond the Time Barrier” y “The Amazing Transparent Man” que, finalmente, serían distribuidas por separado. La mejor de las dos fue ésta, que se inscribía en la corriente de advertencias sobre los riesgos de la energía nuclear. En un futuro catastrófico, la humanidad parece condenada a la extinción. La llegada de un hombre procedente del presente. Conseguirá hacer reaccionar a la abúlica y explotada población. El héroe regresara a su tiempo para advertir a las potencias de la locura que supone la carrera armamentista nuclear. Realizada con una extremada modestia, sin apenas ningún efecto y con una decoración reducida a un mero apunte, es un perfecto ejemplo de la utilización inteligente de los presupuestos de la serie B. Aunque, como muy a menudo, con algún expolio: una de las mejores escenas de la película, los mutantes trepando por una escalinata, en realidad pertenece a “Das Indische Grabmal” (“La Tumba India”, 1958) de Fritz Lang. Al margen de su obvio discurso, su valor reside en una estilización formal que enlaza con los principios del expresionismo.
